Philadelphia Wage and Hour Dispute Lawyers

Do you qualify for overtime pay? Are you an exempt employee? Does your employer classify you as an “executive,” “professional,” or “administrative” employee? Do you spend less than 20% of your time performing non-exempt functions (i.e., functions that an executive, professional or administrative person wouldn’t normally do in the course of their job?) State and Federal Wage and Hour laws, such as the Fair Labor Standards Act, may impact the rights of employees and obligations of employers with respect to overtime pay.

Generally speaking, where an employee who works over 40 hours per any seven day week, the Wage and Hour laws provide that the employee must be paid overtime at the rate of one-and-a-half times the employee’s hourly rate. These rules do not apply, however, to employees who are deemed “exempt,” that is, “executive,” “professional,” or “administrative” employees.

Many employers mistakenly or deliberately classify employees as “exempt” and do not pay them overtime when they, in fact, are not exempt.
